Part of answering your question requires asking another question. If a male and a female were the ones kissing in the lobby, would you want them fired also? What about two females kissing? Some states are now starting to protect against discrimination based upon orientation, so check your state law first. If you have a vetted employee handbook which states that public displays of affection are against company policy, you may have discipline grounds. But if your policy against this does not clearly state it's a firing offense, then firing may not be a best option. As always, every HR action either creates or supports precedent. So whatever policy is imposed upon straight employees should also be similarly imposed upon others. Beef up your employee handbook, have it cleared by legal counsel and acknowledged in writing by employees, and stand by what your discipline code says.
