Worked 7 days with no pay, here's their response: You were engaged with NewsTeam under an Independent Contractor Agreement as a self-employed contractor, not as an employee. As your agreement explains: “This is NOT a contract of employment. This is a contract to provide services as an independent, self-employed contractor who can use helpers or substitutes to provide the services as needed.” “This agreement does not make you an employee, worker or partner of the Company.” Your agreement also sets out how the contract can be ended and what happens if services are not provided: Termination and notice (Section 10) “Either you or the Company can end this agreement at any time by giving 28 days’ written notice for any reason.” “If you do not provide services to the end of your notice period you will be charged deductions as detailed above.” “If you or your helper/substitute fail to provide services 3 days or more in a 28-day period, the Company has the right to end the contract immediately without further payment.” Deductions (Section 4) “Not showing up and not sending someone else to complete the deliveries for you. You will not be paid for that day and you will be charged either: twice that day’s planned earnings or £80 (whichever is higher).” “Any deductions will be taken from the balance owing to you before payment is made for each 4-week period. This could mean that no payment would be made to you for a given period if the deductions exceed the balance owing to you.” Because you chose to stop providing services immediately, without giving the required 28 days’ written notice, the Company has treated the agreement as ended in line with Section 10.
