First step of their process (received almost immediately) : As part of their hiring process, I was required to complete an AI-powered interview that lasted approximately 30 minutes.
FCRA Violations I Experienced:
No Disclosure: I was never provided with a standalone disclosure (separate from the application) informing me that an AI screening tool would generate a consumer report about me for employment purposes.
No Written Consent: I was never asked to provide written authorization for the company to obtain a consumer report about me via the AI screening service.
No Adverse Action Notice: After completing the AI interview, I received ZERO communication from the company for months. The position has now closed, and I was never notified ]that I was rejected. I never received:
A copy of any consumer report generated about me
Notice of my rights under the FCRA
Information about the company that provided the screening report
Notice of my right to dispute the accuracy of information
Complete Ghosting: For months, the company provided no updates, no rejection notice, and no communication whatsoever despite my having invested significant time in their AI screening process.
Impact:
This experience wasted my time, left me in prolonged uncertainty about my application status, and denied me my rights under federal law to know what information was collected about me and how it was used to make employment decisions.
I am joining a class action lawsuit to hold both the AI screening company and Groff Landscapes accountable for potential FCRA violations.
