This employee worked for the company for - as documented - 8hrs. Total. They, in writing, acknowledged the role as a part-time position. When that was reiterated, they quit. Within 30mins, we processed their final paycheck and wished them the best. However, at that point, this individual started harassing and extorting the company, claiming that if he wasn't paid for extra hours that he chose not to log on his timesheets, he would 'sue us' and 'turn us into the labor board' and 'write terrible reviews' online (see above) He was mad, apparently, that our CEO had processed his resignation so quickly, even though said resignation was sent around 7PM PST, and was stated to be 'effectively immediately.' CA state law says that employes must process all final paychecks the day the employee departs the company, so that is what the company did. As for the additional hours this employee claims to have worked, we have informed him we are happy to pay any additional hours worked so long as he can provide a timesheet and record of them; he has declined to provide this to us.
I would ask anyone reading this to keep 2 things in mind: 1) the employee worked at the company for 8hrs total, 2) this review was threatened to us as a retaliatory measure for not paying the employee money he claims to be owed, but that we as of now, have no record of him working, and for records that he himself has been asked to provide, yet has never provided.
Thank you!
